Following its pass (2004), the Codice dei beni culturali e del paesaggio implemented the guidelines of the European Landscape Convention (Florence 2000, ratified in Italy with Law 14/2006), and of the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage (Paris 2003) and Convention on the Protection and Promotion of the Diversity of Cultural Expressions (Paris 2005). It has thus equipped itself with protection tools aimed at identifying the intangible component of the cultural heritage, recognizing it as inseparable from the physicality of the asset.
This new and relevant structure of the Code allows a reading of the territory in the complexity of the different cultural - material and immaterial - and landscape components, guaranteeing more effective cognitive approaches and consequent protection actions.
In particular, the combined provisions of the articles 7 bis and 10 of the Codice provides a tool of particular interest in the recognition of cultural values, expressed in all their forms, from architectural emergencies to elements of demo-ethno-anthropological value.
If the regulatory schedule is adequate, however, difficulties emerge in protection actions, which must be shared between the various authorities called upon, within their respective competences, to carry them out in synergy.
